Welcome to The Ram Rack (the “Store”). These Terms of Service (“Terms”) govern your use of our website, services, and products provided through the Store. By accessing or using the Store, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Store.
1. Use of the Store
Eligibility: To use the Store, you must be at least 18 years old or have the consent of a parent or guardian. By using the Store, you represent and warrant that you meet this eligibility requirement.
Account Registration: You may need to create an account to access certain features of the Store. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2. Orders and Payment
Order Acceptance: All orders placed through the Store are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud prevention department.
Pricing and Availability: All prices are displayed in U.S. dollars. Prices and availability of products are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions at any time, including after an order has been placed.
Payment: Payment for all products must be made by credit or debit card at the time of purchase. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your purchase.
3. Shipping and Returns
Shipping: Shipping and handling charges are displayed at checkout. We will make reasonable efforts to ensure that your order is shipped promptly. However, we are not responsible for any delays in shipping.
Returns: We accept returns of unworn, unwashed, and undamaged items within 30 days of the purchase date. To initiate a return, please contact our customer service team. Return shipping costs are the responsibility of the customer unless the return is due to a defective or incorrect item.
4. Intellectual Property
All content, including text, graphics, logos, images, and software, is the property of Good Shepherd Catholic School its content suppliers and is protected by U.S. and international copyright laws. You may not use, reproduce, distribute, or create derivative works of any content without our express written permission.
5. User Conduct
You agree not to use the Store for any unlawful purpose or in any way that might harm, damage, or disparage any other party. You further agree not to:
- Violate any applicable laws or regulations;
- Infringe the rights of any third party, including intellectual property, privacy, and contractual rights;
- Transmit any harmful or disruptive code, such as viruses or malware;
- Interfere with the operation of the Store or any user’s enjoyment of the Store;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
6. Disclaimers and Limitation of Liability
Disclaimer of Warranties: The Store and all products and services offered through the Store are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Store will be uninterrupted or error-free, that defects will be corrected, or that the Store is free of viruses or other harmful components.
Limitation of Liability: To the fullest extent permitted by law, Good Shepherd Catholic School and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Store or these Terms, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.
7. Indemnification
You agree to indemnify, defend, and hold harmless Good Shepherd Catholic School, The Ram Rack and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Store.
8. Governing Law and Dispute Resolution
These Terms and any disputes arising out of or relating to these Terms or the Store will be governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of such courts.
9. Changes to These Terms
We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Store. Your continued use of the Store after such changes constitutes your acceptance of the new Terms.
